Florida sales tax exemption for aircraft parts and repairs

Has anyone in Florida ordered sales tax exempt parts from Van? If so, did Van charge you Florida sales tax?

I am going through this with them right now. Give them a call and speak with Kelsey. She will send you a link to fill out
 
I haven’t seen my money yet. I used the pull down menu on the Avalaro web site to pull down the “state exemption” option. Then i uploaded the state statute to the website. She claims they will refund the tax they charged me
 
When I inquired about this several years ago, I was advised that Florida deferred tax for "replacement" only parts. Regardless of if you can do this it would only delay the taxation process, so I paid it and received a tax credit later. Keep us advised if you get a different outcome and good luck.

This is the Florida statute:

Repairs, Maintenance, Parts, and Labor - Replacement engines, parts, equipment, and labor used in or for the maintenance or repair of fixed wing or rotary wing aircraft (helicopters) with a certified maximum takeoff weight of more than 2,000 pounds are exempt from sales and use tax. Dealers who make tax-exempt charges for replacement engines, parts, equipment, and labor used in or for the maintenance or repair of aircraft over 2,000 pounds are required to document the Federal Aviation Administration registration number (“N-number”) and the maximum certified takeoff weight of the eligible aircraft on the bill of sale, invoice, or other tangible evidence of sale.
 
Since Vans does not have a presence in Florida I can't see why they feel obligated to charge sales tax on any purchases. IIRC they didn't in the past until the bankruptcy. It should be up to the buyer to determine that requirement.

This is the link Kelsey emailed me and how I selected the state statute. Avalara is the company they are using to handle the tax calculation. I then uploaded the statute. Kelsey claims that it worked and they would cut me a refund.....

You are thinking of the old laws. The '18 supreme court ruling created the nexus concept and most states adopted that and set new laws requiring the collection of taxes based upon the amount of the sellers economic activity in their state. A physical presence is no longer a factor under those laws. Each state has different threshholds, but today you will find very few sellers not collecting sales tax. States can now reach across stae lines on collection enforcement.

Bill, I got the same link but it takes me to a place where I have to print and complete a pdf form. Except the form is for Resale and it asks for the following:

"Important – To satisfy sales tax exemption requirements, please send the following forms back to us:

1. This cover page AND

2. A copy of the current year Florida Annual Resale

Certificate for Sales Tax (Form DR‐13). An
example of this form is provided."

What am I missing? Do I need to signup and create an account?

Unfortunately, the email link seems to disappear once used so I have no way to play around on the website.
 
A quick update to this issue. We're definitely aware of it and are working toward a solution. We work with a third-party vendor to calculate state and local taxes, which sends back a quote, which we then apply to web orders as well as kit/engine/propeller sales. Some of these carve-outs are challenging for them, no surprise considering how many different tax rates and layers there are. Florida's, especially, since it only applies to certain aircraft types. We are applying pressure to get this resolved.

Van member asked me to upload my Drivers License on their website. Not sure if it has worked.

Are you trying to just delay sales tax for an airframe registered in Florida? Florida sales tax elimination is for replacement parts but first the original parts sales tax needs to be paid. I went through this several years ago with my accountant and he basically told me you can pay Florida now or pay them later, it's up to you. I choose then as my tax deductions was better at that time when I was working.

I think we all agree. I am only commenting in the hopes that someone at Van reads this forum and hopefully make a focus effort to right things up. Certainly, Van did not get into bankruptcy because of the great customer service they provided, so why skimp on that!

In my case, the amount of disconnect in the emails was a bit surprising. I was told to complete the tax form instead of addressing my questions about the correctness of the form they provided. It turned out at the end, that uploading DL was the apparent solution, not completing a form that had nothing to complete.
 
Amazing! I found a credit for the taxes paid on my credit card for the amount. Maybe things are starting to improve! Still no return phone calls or reply.
 
don't forget the exemption will only apply to the RV-10, 14, 15 because of the max weight must be over 2000 lbs.
