Note that a waiver will not necessarily cover you in case of an event (some States may have exclusions to such waivers of liability). You may want to consult a lawyer.
This is a subject I have thought about often . I like to taking anyone up who ask for a ride . I can remember like it was yesterday getting my first ride, I was 10 years old at the time. I would feel like a jerk asking for someone to sign a waiver but am I being irresponsible and putting my family at risk should something happen . I have never asked for a waiver and just took a chance may not be the smartest move .
Just remember that per your operating limitations, you must advise your passengers of the experimental nature of your aircraft and that it does not meet the certification requirements of a "standard certificated" aircraft.
and thats a darned good thing to put in huge bold print at the top of a waiver. At least you can prove they were informed of the nature of the craft. If you're not around to defend your estate at least it removes that avenue of a suit against it.
