I'm having a super difficult time getting the AN470-4-4 spar/ rib rivets set on the inboard portion of the aileron. I have managed to drill out and actually get 3 of them in. The forth however, is proving to be a pain and after multiple tries with even a 5-5 continuing to bend over. At this point instead of continuing to screw up the hole more, I'm thinking of just using a 5-4 cherry max in there and move on. Since the cherry max is considered structural I don't see any issue with it. I'm also open to any other suggestions. Thanks

The issue I would have is that the hole is not round; a traditional driven rivet will deform and fill a slightly irregular hole. A cherry-max, otoh, will not.

Not sure that it would make a difference here but something to consider.

I don’t know if this helps, or you want to buy another tool, but I used a big betha straight bar with good success.

Yes you can substitute using the Cherry Max rivets. I used a few of them when I had problems bucking the standard rivets. Just make sure you get the correct size rivets.
