Default Small vs Large N Numbers

What size tail numbers does everyone use/plan to use? A summary of CFR 14 Sec 45.29 says that if an experimental that has a cruise airspeed above 180 the large N numbers are required. Ok... I have seen pictures of -8s with small numbers and several with large numbers.

How do you justify it with the FAA? Do you just use the 75% cruise numbers that Van's provides? (160HP=197mph/171knots, 180HP=204mph/175 knots, 200HP=212 mph/184 knots)

Using that logic, if you install a 200 HP engine you need 12 inch letters.

I am curious only as an academic exercise, but prefer the small N numbers.

The regulation states 180 knots calibrated airspeed, meaning indicated.(IAS) Van's numbers are true airspeed. 180 knots indicated at 8000 feet (on a warm day) is around 212 knots true (TAS). That is my story and I'm sticking to it.
